Terms And Conditions

Applicability: The provisions outlined and mentioned below (in this shipper) shall be applicable to transportation via all modes and are not limited to a single mode of transport.

  • Delivery refers to handing over the shipment to the parties or notifying them about the shipment's arrival at the destination.
  • Parties refer to and include the Shipper, the Receiver, or their authorized representatives.
  • NCV - stands for No Commercial Value, as stated by the Shipper.
  • Freight refers solely to the basic freight charges and does not include additional components such as taxes or other fees.

Declaration:-

  • Shipments handed over by the parties to the Courier Service are strictly booked on a "SAID TO CONTAIN BASIS."
  • The docket is prepared solely based on the declaration provided by the parties. The Courier Service will not be held liable for any incomplete, incorrect, or false declarations.
  • The docket is generated entirely based on the declaration submitted by the parties. The Courier Service bears no responsibility for any inaccurate, incomplete, or incorrect declarations.
  • Courier Service will not process any godown bookings or deliveries unless the "Declaration Form" provided by the operating unit is fully completed, along with the required enclosures, and submitted to the authorized person.
  • If any discrepancy is found between the weight declared by the Sender and the actual weight or volumetric weight of the shipment, the parties will be required to pay the difference in charges.
  • Similarly, if the rate specified by the Shipper is found to be lower than the agreed or contracted rates, the difference in rates will be charged to the parties.

Documentation:-

  • The parties are required to provide proper and complete documentation, including accurate details such as the Sender/Receiver’s name, addresses, mobile numbers, email IDs, as well as necessary forms, permits, waybills, invoices, and other documents as per statutory requirements.
  • RCS will not be held responsible or liable for any deficiencies in the documents or statutory requirements. No claim or grievance will be entertained if it arises from the issues mentioned above.
  • The parties agree to compensate Courier Service for any loss if their shipment causes damage to other shipments in the vehicle due to its inherent nature and incorrect declaration, or if it is seized by a government authority due to improper or incomplete documentation, resulting in delays to other shipments and causing a loss to Courier Service.”
  • The parties agree to compensate Courier Service for any loss incurred if their shipment causes damage to other shipments loaded in the vehicle due to its inherent nature and incorrect declaration. Additionally, if the shipment is seized by any government authority due to improper or incomplete documentation, resulting in delays and losses to other shipments, the parties will make good the loss to Courier Service.”

Assurance of Delivery:-

All shipments come with an "Assured Date of Delivery" except for shipments booked under the STANDARD Product. The assurance of delivery by the stated date is subject to the following conditions:

  • The date of intimation for the delivery of a shipment, or the first delivery attempt, is considered as the deemed delivery.
  • For shipments containing electronic items or heavy items that cannot be scanned, a cooling period of 24 hours may be required. As a result, an additional day will be added to the transit schedule. This applies only to shipments that are booked under priority service.
  • If the assured date of delivery coincides with a Sunday, holiday, political road block, or any other such event, the next working day will be considered the assured date of delivery.
  • Delivery assurance will not apply in cases of accidents, acts of God, force majeure, floods, strikes, political roadblocks, acts of enemies of the state, or any events beyond the control of the Courier Service.
  • Delivery of shipment would be made on payment of Freight Charges which shall include all components as specified on the Consignment Note/Shipper. In case of Cash/Cheque on Delivery (COD), shipment would be delivered only on receipt of the COD amount as specified by the Shipper.
  • Shipments will be delivered only upon payment of the freight charges, which include all components specified in the Consignment Note/Shipper. For Cash/Cheque on Delivery (COD) shipments, delivery will be made only after the COD amount, as specified by the Shipper, is received.

Liabilities:-

  • The courier service's liability for any delay in delivery of the shipment (subject to applicable exceptions) shall be limited to the "freight" amount only.
  • If the Higher Risk Rate is paid, the Courier Service will be liable to the extent of the actual cost of the shipment, the value declared by the parties, or the actual loss suffered by the parties (whichever is lower), as indicated in the documents issued by the Courier Service.
  • The Courier Service shall not be held liable for any indirect, consequential, remote, or exemplary losses, damages, or claims.
  • If the value of the shipment is declared by the parties as NCV (No Commercial Value), the liability of the Courier Service shall be limited to Rs. 100/- (One Hundred Rupees only).
  • The Courier Service assumes no responsibility or liability if the material appears outwardly intact at the time of delivery. Claims for damage, shortages, breakage, leakage, pilferage, or similar issues will not be entertained once the delivery is accepted, under any circumstances. However, if the shipment appears to be damaged, the parties may request an open delivery to assess any potential loss, following the proper legal process and the policies and procedures set by M/s. Courier Service.
  • Any value-added services, such as Cash on Delivery (COD), provided by the Courier Service for an agreed charge, are offered without any liability on the part of the Courier Service, whether civil or criminal. The Courier Service is not responsible for the contractual obligations or payment terms between the Sender and Receiver, or any other parties involved.
  • In the event that any Pay Order collected from the parties on behalf of the Shipper is found to be fraudulent or not genuine, the Courier Service shall not be liable under any circumstances. The Courier Service is not responsible for any fraud or issues related to payment between the parties involved. The Courier Service's role is solely to act as a service provider in collecting the Pay Order or other payment instruments, as per the instructions given by the parties at the time of delivery, for eventual delivery to the Shipper.
  • The Courier Service shall not handle any instruments unless specifically instructed by the Sender.

Payments:-

  • If the parties do not take delivery of the shipment for any reason, Courier Service shall issue a bill to the parties for transportation and other charges as per the terms of the docket. The parties shall be responsible for paying all dues owed to Courier Service, whether at the original booking station or any other station.

Online Payment

All online payments for services rendered by the Courier Service shall be considered accepted only when the due amount is credited to the Company's account. Payment will be due on the date specified in the invoice, unless the Company has agreed to different terms through a written agreement signed by an authorized representative and subject to the Company's credit approval policy. If an invoice is not paid by the due date, an interest of 2% per month will be charged on the overdue amount, from the due date until the full payment is made to the Company.

Claims

  • The Courier Service will not entertain any claims for loss, shortage, damage, non-delivery, breakage, leakage, pilferage, or similar issues unless a written claim is submitted within thirty (30) days from the date of the docket, and is supported by remarks on the Proof of Delivery (POD).
  • The parties are not entitled to deduct, adjust, or set off any amount for claims, including those related to loss, delivery challans, etc. However, M/s. Courier Service will provide cooperation if necessary, to assist the Shipper in obtaining duplicate copies and settling their claims independently of any payments due to the Courier Service.
  • The Courier Service will not entertain any claims arising from the decay or deterioration of material due to delays in the delivery of the consignment, regardless of the reason for the delay.

Arbitration

  • The business operations of the Courier Service are decentralized, with operational autonomy granted to each respective zone based on geographical coverage. The responsibility and authority for the performance of all obligations under this agreement rest solely with the Zonal Heads for each zone. The directors or Chairman of the Courier Service are not directly involved in the day-to-day operations of the decentralized units or in matters related to the performance of the obligations under this agreement, which remain the exclusive responsibility of the Zonal Heads.
  • In the event of any dispute arising out of or in relation to this Docket, the matter shall be referred to a sole arbitrator appointed by the Courier Service. The arbitration will be governed by the provisions of the Arbitration and Conciliation Act, 1996, as in force, along with any amendments made from time to time. The award of the arbitrator shall be final and binding on all parties involved.
  • This contract shall be interpreted in accordance with the laws of India. Any proceedings arising from or related to an award or interim order by the arbitrator shall be subject to the exclusive jurisdiction of the appropriate courts in India.
